These terms govern your use of Dailies. By creating an account or using the service, you agree to them. If you do not agree, do not use the service.
Eligibility and account
You must be at least 18 years old and legally able to enter these terms. Sign in with Apple identifies your Dailies account. Keep your device and Apple account secure. You are responsible for activity you authorize and for ensuring that your prompts, uploads and films comply with these terms and applicable law.
What the service does
Dailies uses Apple Foundation Models, Anthropic and fal.ai services to help write plans and generate still images and video. AI output can be inaccurate, unexpected, similar to other work, or unsuitable for your intended use. Review every plan and output before using, publishing or relying on it. A plan, quote or preview is not approval to generate: you choose each priced action.
Your material and generated output
You keep the rights you already have in material you submit. You give Dailies and its service providers a limited right to host, transmit, reproduce and process that material only to operate, secure and improve the requested service, enforce these terms and comply with law.
As between you and Dailies, Dailies claims no ownership of generated output. Copyright and other rights in AI output vary by jurisdiction and facts. We do not promise that an output is unique, copyrightable, non-infringing, accurate or cleared for commercial use. You are responsible for checking and obtaining the rights, releases and permissions your use requires.
Content rules
You may not use Dailies to create, request, upload, distribute or facilitate content or activity that:
- is illegal, fraudulent, deceptive, defamatory, harassing, hateful, threatening or abusive;
- exploits, sexualizes, harms or threatens a child, including child sexual abuse material;
- is pornographic, intended for sexual arousal, non-consensual intimate imagery or sexual violence;
- promotes suicide, self-harm, terrorism, violent wrongdoing, illegal weapons use or other dangerous acts;
- uses a real person’s face, voice, identity or likeness without the permission and legal rights required for that use, including impersonation or deceptive deepfakes;
- violates privacy, publicity, intellectual-property or other rights;
- classifies people using biometric data to infer sensitive traits, performs prohibited social scoring, or makes unsupervised high-impact employment, medical, legal, financial, law-enforcement or criminal-risk decisions;
- circumvents safeguards, probes or extracts model training data, compromises systems, removes AI labels or content credentials, or abuses service limits.
Safety systems are imperfect. We may refuse a request, remove access, preserve or disclose information when legally required, and report apparent child-exploitation or other unlawful material to the appropriate authorities. Report a concern through the app or at [email protected].
Subscriptions and credits
Purchases are processed by Apple and are also subject to Apple’s terms. Dailies offers weekly and monthly auto-renewing subscriptions in one subscription group and may offer an optional extra-credit pack. The app shows the current localized price and exact credit amount before purchase or generation.
- Subscription allowance credits are valid for the signed paid period. Unused weekly or monthly allowance does not carry into the next period.
- Extra credits bought as a separate pack do not expire and can be used without an active subscription. The purchased balance is capped at 500 credits.
- Welcome or beta credits are promotional, may be limited by a global pool, and may expire as disclosed when granted. They are not cash and are not refundable.
- Credits are not transferable, have no cash value and can be used only for Dailies generation services. A quote expires after five minutes and changes when its inputs or provider price change.
- Cancel or change a subscription in Apple’s Manage Subscriptions screen. Cancellation stops future renewal and does not shorten the current paid period. Deleting Dailies or deleting your Dailies account does not cancel an Apple subscription.
- Restore Purchases restores eligible remaining balance and subscription state; it does not recreate spent or expired credits.
Apple decides refund requests. Where law requires a refund or remedy, these terms do not limit it.
Availability, limits and changes
Models, prices, features and availability can change. Requests may fail because of safety rules, model availability, network conditions, balance, daily limits or provider limits. We may apply per-account, per-installation and service-wide caps to protect users and control abuse. We will show a new price for your approval before a changed paid generation; we do not silently switch a generation endpoint or reference.
Account action and deletion
We may restrict or terminate access for a serious or repeated violation, security risk, fraud, charge reversal or legal requirement. You may delete your account in Settings. Deletion removes service credentials and operational account data, while local projects and footage remain on the device. A pseudonymous billing archive remains for purchase recovery, refunds and duplicate-redemption prevention as described in the Privacy Policy.
If the generation service closes
We will stop new sales, give advance in-app and App Store notice where practicable, allow a spend-down period, then stop new generation. Local playback, editing and export remain available. You may ask Apple to refund unused extra credits; Apple decides the request. We will keep support and the billing archive available for at least 180 days after shutdown.
Disclaimers and responsibility
Dailies is provided on an “as is” and “as available” basis to the extent permitted by law. We do not promise uninterrupted service or a particular creative, legal or commercial result. Nothing in these terms excludes warranties, remedies or liability that applicable consumer law does not allow us to exclude. You remain responsible for your films, their publication and their effect on others.
Changes and contact
We may update these terms for legal, safety or service changes. We will post the new effective date and give notice of material changes in the app when appropriate. Continued use after the change takes effect means you accept the updated terms, to the extent permitted by law.
